Press Release: National Lawyers Guild Announces Support for a New Mexico Green AmendmentAlbuquerque, NM: After review and internal deliberations, the National Lawyers Guild New Mexico Chapter has announced its support for the proposed New Mexico Green Amendment. The constitutional amendment would recognize an enforceable right of the people of New Mexico to a clean, safe and healthy environment.“Environmental rights that are a clear and enforceable right of the people has been sorely lacking from New Mexico’s state constitution. The proposed Green Amendment would correct this oversight of history. While many point to Article XX Section 21 as demonstrating an appreciation for natural resource protection in the state, by its terms the amendment does not provide the same constitutional standing for the environment or environmental rights that the proposed Green Amendment will once passed,” explains Lora Lucero, member of the National Lawyers Guild.“National Lawyers Guild support for the New Mexico Green Amendment sends a powerful message about the values of having this quality of constitutional recognition in the state,” said Maya van Rossum, the founder of the national Green Amendments For the Generations movement, and author of the book The Green Amendment, the People’s Fight For a Clean Safe & Healthy Environment. “The proposed New Mexico Green Amendment language is clear in recognizing clean and healthy air, water, soil and environments; healthy native flora, fauna and ecosystems, and a safe climate as a clear and enforceable right of the people. New Mexico’samendment includes an explicit mandate for statewide environmental justice and ensures an obligation on government officials to protect the states natural resource for both present and future generations. And, by recognizing the cultural, natural and healthful values of the environment, New Mexico’s amendment also recognizes Native American and indigenous values of a healthy environment, as well as the importance of a clean environment for human health, wildlife and biodiversity,” added van Rossum.Lucero adds, “the amendment has secured growing support each of the 5 years it has been proposed. As a constitutional amendment, the level of review and consideration can be more intense than for other pieces of legislation, but once secured the amendment will also provide a higher level of protection for all aspects of our New Mexico environment and so is worth the effort.”Montana, Pennsylvania and New York are currently the only three states that protectenvironmental rights as an inalienable right in the Bill of Rights section of the state Constitution, with New York achieving passage of their amendment in November 2021.
